Considering divorce is a big step. Whether the decision is already made or you’re still figuring things out, it’s completely normal to feel unsure, anxious, or even a little lost; there’s a lot to take in — emotionally, legally, and practically.

Here’s a little overview of the divorce process in the Netherlands.

1. What are my options for getting divorced in the Netherlands?

In the Netherlands, there are a few different ways to go through a divorce. Some couples opt for divorce mediation especially when they want to reduce stress and conflict.

Mediation is a cooperative approach. Partners work together with a neutral mediator to come to agreements about everything that needs to be arranged: parenting, finances, property, and more. It’s often more affordable, more private, and less emotionally draining.

2. How does divorce mediation work?

Mediation is a structured but flexible process that’s tailored to your situation. You and your partner meet with a mediator — usually over a few sessions — to have honest, guided conversations about the separation. The mediator helps make sure both of you feel heard and supported, and that the agreements you reach are fair, clear, and sustainable.

Everything is done at your pace. Some couples move quickly, others take more time — and that’s okay. There’s space to reflect, ask questions, and get clarity before making any final decisions.

3. How long does the divorce process take?

It really depends on how complex your situation is and how easily you’re able to come to agreements. With mediation, many couples are able to complete the entire process — from the first conversation to the legal registration of the divorce — within a few months.

Compared to traditional court proceedings, mediation tends to be quicker and there’s more control over your own timeline.

4. What about the children, the house, and our finances?

These are often the most emotional and complicated parts of a divorce — and they deserve time and thoughtful attention. Mediation gives you a supportive space to talk through:

  • Parenting: What kind of arrangement is best for your children? How will you share responsibilities? You’ll work together with the mediator on a parenting plan that’s realistic and centered on your kids’ well-being.
  • Property and the family home: Whether one of you plans to stay in the home or you’re considering selling, you’ll explore the options and find a solution that works for both of you.
  • Finances: You’ll look at income, savings, debts, and any necessary financial support. The goal is to reach agreements that are transparent, balanced, and legally sound.

5. Will we still need lawyers?

In mediation, the mediator acts in the interests of both parties. That’s part of what makes it so accessible and cost-effective. Once you’ve reached an agreement, our lawyer reviews it and meets with you to ensure that your wishes have been accurately recorded and that both of you understand the legal implications of what you’ve agreed

Once finalised, your agreements are submitted to court and a judge issues a divorce ruling. Your divorce is official when the divorce ruling has been registered at the municipality and recorded in the persons register (BRP).
